Crosswalks are meant to offer a safe area for pedestrians. They are supposed to give pedestrians a clear right of way. They are supposed to signal to drivers an area of the road where they have to use caution. They are usually clearly marked. They are often controlled by traffic signs or light signals. Nevertheless they do not guarantee pedestrians a safe location to cross a street. The accident left the pedestrian with a thoracic level spinal cord dislocation resulting in total paralyzes from the chest down.. The law firm that handled this case filed a claim for the pedestrian victim against the driver and the car rental company. Unable to reach a settlement, the law firm took the case to trial. The jury verdict was partially upheld to the sum of $20,300,000 by the trial judge. This included $10 million for future pain and suffering. The remainder covered the cost of medical care, past and future loss of earning capacity, and pain and suffering.

Case 3: This claim report involved the driver of a school bus making a left hand turn at an intersection. While making the turn the bus ran over a pedestrian's foot. The pedestrian was a 54 year old female who was walking across an intersection in a designated crosswalk. The driver of the bus was oblivious to what had transpired. It took the efforts of witnesses getting the driver's attention and getting the driver to go into reverse so that the wheel of the bus would release the pedestrian's foot. The pedestrian sustained several severe injuries to her foot and leg. The woman had to have multiple surgeries in an attempt to save her leg. Ultimately, though, she lost her leg as she required a below the knee amputation. Following the amputation she suffered from constant phantom pain. The law firm that handled the personal injury claim reported that the case went to trial and the jury awarded the victim $5,900,000.

By comparing and contrasting these case we discover first that each case is unique. Extrapolating from the lawsuit it is clear that a case can involve a car, a bus, a truck, or even a motorcycle. The plaintiffs, even when we consider incidents involving only pedestrians, can be male or female and can be any age.

The cases, however, do tend to share a number of things in common. First, crosswalks are no guarantee of safety. Drivers are easily distracted. In the first claim above the driver failed to even realize she had caused an accident and had run over a person. In the second lawsuit the driver was speeding and did not stop for a red light. In the third lawsuit bystanders had to get the driver to back up in order to release the pedestrian's foot pinned under the vehicle.
