As a patient in any medical establishment, it is a legal necessity that an adequate standard of care is delivered by all members of medical staff. When this is not the case, then it can be resultant in patient injury. This happening is referred to as medical negligence. As mindful as those delivering care are, occurrences of medical negligence do take place: these people are merely human. For this reason it is a legal requirement for all practicing medicine to be covered by liability insurance. There is much resonance here, as damages pertaining to medical negligence can run into the thousands.

In such cases the patient is generally referred to as the plaintiff. The plaintiff is also a term that may be used to denote the legal representative that is acting on the behalf of the patient. The opposition party is the defendant, which is made up of those that represent the ostensibly negligent party, be it dentist, nurse, doctor, or otherwise.

In order for a case of medical negligence to result in damages being awarded to the plaintiff, the defendant has to be proved wrong on several counts. Firstly it needs to be established that the defendant had a legal obligation toward the patient (which exists by virtue of a patient receiving treatment). Secondly it needs to be established that there was a breach in relation to this legal duty. Thirdly it must be established that this breach brought about injury. Fourthly, it needs to be established that the injury has been resultant in fiscal, emotional, or physical loss.

Compensatory damages are always awarded to a plaintiff who has succeeded with a claim. These compensatory damages are inclusive of, firstly, financial damages, and, secondly, non-financial damages. Therefore a person is awarded remuneration for the actual monetary losses resultant of medical negligence, and also the actual injury/ies resultant of medical negligence. There can also be punitive damages awarded, that are designed purely to punish the defendant.

As a victim of medical negligence it is important to be aware that it is a victim’s legal right to claim personal injury compensation. It is really important that appropriate legal representation is sought, if a claimant is to be awarded an amount of compensation that is warranted. Therefore, an appropriate legal representative is a lawyer that specialises in cases of medical negligence. It is also important that the representative has been to court in order to defend cases of negligence. If this is not the case, then the defendant legal team are likely to take advantage of the inexperience.
