Patient Passed Away From Colon Cancer Metastasis After Her Physician Ignored Her Reports Of Symptoms

Less than one percent of those diagnosed with colon cancer are younger than 35. However, given the fact that colon cancer can kill doctors usually concur that the presence of rectal bleeding, even in someone below thirty-five, needs to be investigated by a colonoscopy in order to figure out if the bleeding from a tumor.. Simply assuming that the blood is from hemorrhoids does not meet the standard of care.

Take, for example, what took place in a reported case concerning a woman who told her family doctor that she noticed blood in her stool and experienced pain as she had bowel movements. She was just twenty four years old. The doctor, just\without even conducting an examination, told her to take a laxative after diagnosing her with diarrhea and other bowel issues. She returned four months later with complaints of constipation, pain and problems sitting. This time the physician at last examined her yet assured her she had hemorrhoids. The physician recommended an enema. The woman saw that doctor two more times and every time was told that her symptoms were due to hemorrhoids and she had nothing to be concerned with.

She had to be rushed to an emergency room because of extreme pain seven months following her original trip to her primary care physician. They set her up for a colonoscopy through which she was diagnosed with advanced colorectal cancer. The cancer was so widespread by the time she had surgery that not only did the surgeon need to remove a portion of her colon but in addition had to remove her uterus and a section of her lower intestines. She then had to undergo chemotherapy. The woman subsequently had a recurrence and died of the cancer less than 3 years after. She was survived by her husband and daughter, a minor.

The law firm that represented the family documented that the case went to trail and the jury come back with a verdict of $2,500,000. The amount included $350,000 the most allowed for pain and suffering under the law of the State where the doctor practices. The rest of the amount was for future lost wages. This claim illustrates what is perhaps the most common medical mistake concerning the delayed diagnosis of colon cancer.

Far too often physicians do not perform a colonoscopy or send the patient to a gastroenterologist when a patient reports rectal bleeding or blood in the stool. Rather, these physicians merely assume that the symptom is caused by hemorrhoids. This is especially typical when the patient is less than 50 years old.

When a situation like that described above occurs and the person passes away due to the fact the cancer progressed to the point of not being curable due to the delay in diagnosis the surviving family might be able to bring a claim against the doctor responsible for the delay.
