Real Estate Agent A Salesperson?

People that are looking to buy or sell real estate often think of real estate agents as a sales person. There’s no doubt that many agents in today’s real estate world would be enthusiastic about being only a salesperson. But because of the serious nature of selling a piece of real estate, this is not the case. A real estate agent is responsible to their clients more than a salesperson could ever be. They have specialized training and are relied on for their expert advice and opinions.

This responsibility is called “fiduciary duty.” This term refers to how agents are responsible to act in the best interest of their clients. You’ll find that a salesperson in the mall or on the car lot is not always out for your best interest. Their duty is to sell as many items as they possibly can to whoever will buy it. In real estate it doesn’t work that way.

When a realtor sells a property, he’s responsible for that transaction for a very long time. Because of this liability you’ll notice that the local real estate board requires plenty of discourse. The contract of purchase and sale is filled with pages and pages of iron clad liability.

When a realtor is listing your home he is representing the seller of the home. The sellers’ best interest is what matters to the listing agent as he or she is working on behalf of the seller. In some instances there may be a buyer that is interested in purchasing the property but does not have a realtor involved. The listing agent can then form a dual agency and represent both parties to the contract.

Personally, I do not believe in representing both parties to the contract. The buyer should always have an agent that can deal directly with the listing agent. Of course the commission is always better when you represent both the buyer and the seller. But the liability involved in dealing with both parties is not worth the risk.

If you’re thinking of buying real estate you should consider employing the help of a local real estate agent to help with your purchase. Surround yourself with professionals in your area that are reliable and that you can trust. If you cannot trust your network then find a new one and always hold high standards with who you work with. Real estate is no joke so find someone who can represent you.
