A certain alcoholic drink do produce a distinct odor. However a positive alcoholic breath may not mean anything in court. Reason number 1: It is very subjective. Other non-alcoholic beverages, foods, or even certain medical condition may produce odor that may mimic an alcohol. Reason number 2: Positive alcoholic breath is not equal to intoxication. Even methods of measuring alcohol concentration thru breath, blood, and urine were contradicted, questioning reliability.
