According to the law, only the inventor may apply for a patent, with certain exceptions. If a person who is not the inventor should apply for a patent, the patent, if granted, would be invalid. Technically when someone manufactures or sells an item that uses patented technology that person would be in infringement of the patent. If patent infringement does occur, the unauthorized user may receive a cease-and-desist letter by the owner of the patent. The patent owner might be seeking an order to stop the unauthorized user from manufacturing or selling the item that contains the patented technology and they may also be seeking damages and restitution, which can be very costly.
Intellectual Property Rights or IPR is a controlled protection for original works such as writing, identifiers, inventions, and processes. Patent and trademark are some of the many types of intellectual properties.
